Welding Fume Loss Overturned - 9/9/2010
The U.S. Court of Appeals overturned a 2007 welding fume verdict which awarded $20.5 million to welder Jeff Tamraz. The case was one of only five losses for the welding industry in welding fume trials and was the largest verdict to date. Manufacturers involved in the trial were Lincoln Electric, Hobart Brothers and ESAB.
In the appeal, the court concluded that testimony from neurologist Dr. Walter Carlini, which cited welding fumes as the cause of Tamraz’s illness, “was at most a working hypothesis, not admissible scientific ‘knowledge.’”
