Arrests for Buried Cylinders

Kirbyville, TX – A father and son were sentenced to federal prison for burying 113 compressed gas cylinders on residential and ranching property.

Kevin Wayne Hester, president of Simply Aquatics, 34, received a sentence of 20 months in federal prison, and his father, Lyle Hester, 62, received a sentence of 14 months in federal prison. U.S. District Judge Ron Clark also ordered the two to jointly pay $391,442.57 in restitution for cleanup.

The cylinders were discovered when investigators with the Environmental Protection Agency and the Texas Commission on Environmental Quality executed a search warrant at Kevin Hester's home in January 2007. Investigators determined that 33 of the cylinders were under high pressure and contained a combined total of 952 pounds of chlorine gas.

"Certainly in disposing of compressed gas cylinders, burying them in the ground is not consistent with federal law," says David Bary, Dallas EPA regional office spokesman.
